Virginia enacted law to allow utilities to recover costs of energy efficiency programs, including smart meter programs. Dominion Virginia Power has a plan to replace all of its 2.4 million existing meters with smart meters, but it has delayed full deployment of smart meters for additional field testing.

Legislative and Regulatory Activity
In April 2009, Virginia adopted H2506 (Chapter 824), which amends §56-576, §56-585.1 and §56-585.3 of the Virginia Code to allow utilities to recover costs of energy efficiency programs including demand response, Combined Heat & Power and water heat recovery, curtailment, or other programs designed to reduce consumption.

There are 3 investor-owned utilities and 13 rural electric cooperatives regulated by the VSCC.
